1. About This Platform

Hartanex ("we", "us", "our", "the Platform") is an online advertising platform that allows property owners, agents, and third parties to list and advertise properties for sale, rent, or auction across Malaysia. Hartanex is not a real estate agency, valuer, lawyer, financial institution, or party to any transaction between users. By using this Platform, you agree to be bound by these Terms; if you continue using the Platform after any update to these Terms, you are deemed to accept the updated version.

2. No Responsibility for Listings or Transactions

Hartanex acts solely as an advertising medium connecting buyers, tenants, sellers, landlords, and agents. We do not own, inspect, verify, or manage any property listed on this Platform, do not endorse or recommend any lister or agent, and are not involved in and do not participate in any negotiation, agreement, payment, or transaction that takes place between users.

Accordingly, Hartanex is not responsible or liable for:

• The accuracy, completeness, or legality of any listing, price, photo, floor area, or description posted by users or agents
• Any loss, damage, dispute, fraud, or misrepresentation arising from a transaction or communication between users
• The conduct, identity, or legitimacy of any buyer, seller, tenant, landlord, or agent using the Platform
• Any decision made by a user in reliance on information found on this Platform
• Delays, errors, or interruptions to the Platform's availability, which is provided on an "as is" and "as available" basis without warranty of any kind

Users are strongly advised to independently verify property details (including measurements, ownership, and title status), and the identity of the other party, and to seek advice from a qualified real estate agent, lawyer, or financial advisor before entering into any property transaction.

3. User Responsibility & Compliance with Malaysian Law

Anyone listing a property on Hartanex is solely responsible for ensuring the information they submit is accurate and not misleading, and that they have the legal right to advertise the property. Where applicable under the Consumer Protection (Electronic Trade Transactions) Regulations 2024, a lister offering goods or services for sale must clearly disclose, among other things, their name or business name, business registration number (if applicable), contact details, a description of what is being offered, the full price, accepted payment methods, and any relevant terms and conditions. Submitting information you know to be false or misleading may itself be an offence under Malaysian law, and Hartanex accepts no liability for a user's failure to comply with this or any other applicable law.

You agree to indemnify and hold Hartanex harmless from any claim, loss, or liability arising from your listing, your conduct on the Platform, or your dealings with another user.

4. No Professional Advice

Content on this Platform, including loan/mortgage calculators, is provided for general informational purposes only and does not constitute legal, financial, or professional real estate advice. Figures produced by any calculator on this site are estimates only and should not be relied upon for actual financial decisions.

5. Limitation of Liability

To the fullest extent permitted by law, Hartanex, its owners, and operators shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from the use of, or inability to use, this Platform, or from any transaction or dealing between users of the Platform.

6. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms.
